Labor Relations Specialist ( SE27-1)( Repost 10-18-2024)

JOB
Under the general supervision of a Deputy Commissioner, HR Director/Manager or designee, this is highly responsible technical and administrative work in administering the Labor Laws of the Virgin Islands. An employee in this class resolves labor management disputes, resolves charges of employment discrimination, and determines compliance with statutory provisions with respect to wages, hours and working conditions. Work is performed in accordance with established Federal/State Labor regulations. Work is reviewed upon completion of assignments and through reports submitted for consistency of applications and interpretations.

EXAMPLE OF DUTIES
Ensures compliance with laws, rules and regulations governing Labor Management Relations, or Fair employment practices of fair labor standards.Investigates charges of Unfair Labor Practiced, Unit Clarifications, Discrimination, or payroll discrepancies to determine compliance with laws, rules and regulations. Analyzes information gathered to make determination and settlement.Recommends remedial actions to correct violations of noncompliance with appropriate laws, rules and regulations.Responds to inquiries and interviews claimants and/or refers claimants to Compliance Officers to determine if any relief or statute may apply.Reviews and verifies reports submitted to subordinates for completeness and correctness.Maintains accurate and complete case records and files from inception to conclusion in accordance with statutory requirements.Prepares monthly, quarterly, annual, and other comprehensive reports.Provides training, makes presentations, and meets with groups (re: appropriate specialties) in both public and private agencies to discuss, educate and/or settle differences (violations).Conducts case research and processes representation petitions (Labor Management Relations).Collaborates with internal and external stakeholders to address and/or respond to complaints, grievances, and alleged violations of company policies, rules, and standards of conduct and ethics.Provides assistance in the preparation for arbitration and mediation hearings by obtaining supporting documents and/or interviewing witnesses.Advises leadership on labor and employee relations matters including grievance and arbitration procedures, performance issues, and disciplinary actions.Performs other related work as required.

SUPPLEMENTAL INFORMATION
FACTOR 1- KNOWLEDGE REQUIRED BY THE POSITION Knowledge of' the functions, objections, policies and procedures of the Labor Relations Division.Knowledge of Virgin Islands laws, rules and regulations governing labor management relations and fair labor standards.Knowledge of Virgin Islands laws, rules and regulations governing Fair Employment Practice theories and bases of employment discrimination.Knowledge of techniques and procedures of investigation, conciliation and enforcement of the V.I. Labor Laws, rules and regulations.Knowledge and variances between federal and local labor laws of the National Labor Act.Knowledge and variances between federal and local labor laws of Title VII Civil Rights Act of 1964, as amended.Knowledge and variances between federal and local labor laws of the Virgin Islands Fair Labor Standards and the U.S. Pair Labor Standards.Knowledge of collective bargaining agreements.Knowledge of departmental internal operating practices and procedures.Skill in computer operating applications.Skill in time management.Ability to demonstrate professionalism and interpersonal relations.Ability to maintain confidentiality when privy to highly sensitive information.Ability to organize, coordinate, and execute in detail.Ability to think critically and analytically. Ability to communicate effectively orally and in writing.Ability to write clear, concise, comprehensive reports and correspondence.Ability to establish and maintain effective working relationships with all stakeholders during work.Ability to collect and assemble information, engage in case research, analyze both sides of an issue, and make appropriate recommendations. FACTOR 2- SUPERVISORY CONTROLS Work is supervised by a Deputy Commissioner, HR Director/Manager, or designee who provides general instructions about objectives and priorities. Work is performed independently and reviewed by the supervisor through discussions, meetings, and reports to ensure objectives are met and compliance to local laws, policies, regulations, and unionized contracts.FACTOR 3- GUIDELINES Guidelines include the VI Code, federal and local labor laws and regulations, applicable ratified and fully executed union contracts, departmental rules, regulations, policies and procedures, manuals, directives, and Executive Orders.FACTOR 4- COMPLEXITY Work involves implementing appropriate strategies to accomplish objectives. Adherence to the Department’s confidentiality guidelines. Work involves planning and executing sequential projects while considering contingencies and alternatives; managing a myriad of tasks simultaneously. Complex problem-solving and decision-making are necessary.FACTOR 5- SCOPE AND EFFECT The purpose of work is to facilitate continuous training for all levels of management to interpret rules and regulations, policies and procedures, and administer labor contracts. Also, provide step-by-step guidance and instruction to leadership in resolving employee relations issues and labor relations within the workplace.FACTOR 6- PERSONAL CONTACTS Contacts are internal and external stakeholders, supervisors, departmental employees, administrative officials, and union representatives.FACTOR 7- PURPOSE OF CONTACTS Contacts are made to obtain, clarify, guide, or give facts or information to aid in the accomplishment of objectives.FACTOR 8- PHYSICAL DEMANDS Work is primarily sedentary but requires prolonged standing, intermittent walking, lifting objects, and bending. Some fieldwork for off-site training and meetings is required. FACTOR 9- WORK ENVIRONMENT Work is performed in an office setting. Some travel within the territory, off-island, and the US mainland is required.
