WORKING HOURS AND LOCATION
This position generally works Monday through Friday 8:00 a.m. – 4:30 p.m. The position also alternates being on-call every other week and attending court on every other weekend. We value work-life balance, so schedule flexibility exists to accommodate weekend court and completing time sensitive legal matters. The Law Department offices are located in downtown Juneau in the Sealaska Plaza Building directly across from City Hall.

DESCRIPTION OF WHAT YOU WILL BE DOING
The Assistant Attorney performs a broad range of legal work including providing legal advice and litigating criminal and civil matters. The primary need for this position will be criminal prosecution and legal guidance to the Juneau Police Department, which is estimated to account for 95% of the duties. Typical responsibilities include the following:

  • Prosecutes misdemeanors and criminal infractions such as assaults, driving under the influence, larceny, regulatory offenses, and code enforcement.
  • Participates in any court directed program such as the Coordinated Resources Project (CRP).
  • Responsible for all stages of trial and appeal, including legal research, briefing, and oral argument.
  • Responsible for sharing 24/7 calls and weekend arraignments.
  • Assists other City departments by answering legal questions and drafting legal opinions as needed.
  • Performs other related work as required.

We are looking for an attorney who can join our prosecution team to help the community. The two prosecutors work as partners with the support staff. Nearly all of the criminal workflow is paperless, so a prosecutor must be computer savvy.

Criminal misdemeanor trials have restarted after COVID-19 delays, and there is a large backlog of people awaiting trial. In addition to trial experience, a prosecutor is expected to develop and maintain good relationships with community partners, including those that offer diversion and treatment programs.
A new prosecutor needs to be self-motivated to learn CBJ law (i.e. CBJC Title 42, 72, and Chapter 1.40), Alaska law (i.e. A.S. Title 11, 12, and 47), and the Alaska Court Rules. A person in this position will have a week to observe and learn some foundational knowledge before jumping in to arraignments, case screening, Rule 11 negotiations, and trials.
The workload in the CBJ Law Department is fast-paced and requires all attorneys to quickly research relevant law and understand the relevant facts. A qualified candidate will have the ability to formulate well-reasoned arguments. Prosecutors must also be comfortable making quick decisions. Attorneys are expected to prosecute misdemeanor cases and noncomplex civil cases independently with minimal supervision. Trial preparation is collegial and mock trials are encouraged.
WHAT IS IT LIKE TO WORK IN OUR DEPARTMENT
The mission of the Law Department is to empower policymakers by drafting, explaining, and enforcing the law.
We are a collegial team that adapts to the needs of our clients and coworkers. We have a criminal prosecution division with two prosecutors and two paralegals/litigation assistants who prosecute around 1100 cases per year. We have a civil division with three attorneys and one paralegal/litigation assistant who provide a range of legal services including legal advice to clients, drafting legislation, prosecuting civil suits, and defending client decisions. We also have an office manager who directly supervises the support staff and manages the department’s budget. The municipal attorney, who is appointed by the CBJ Assembly, supervises the attorneys and provides overall policy direction to the office.

DO I HAVE THE QUALIFICATIONS FOR THIS JOB – OUR DESIRED QUALIFICATIONS
The Assistant Attorney positions are within the partially exempt service and serves at the pleasure of the Municipal Attorney. Applications and resumes received are subject to public disclosure. This position may be classified at any level based on the applicant’s qualification:

Education for Assistant Attorney 1 & 2: Juris Doctorate from accredited law school is required.
Assistant Attorney 1: (a) Must be eligible to practice under Alaska Bar Rule 44 or (b) Must be licensed to practice law in the State of Alaska and be in good standing with the Alaska Bar.
Assistant Attorney 2: Must be licensed to practice law in the State of Alaska and be in good standing with the Alaska Bar.
Desired Experience for Assistant Attorney 1: Experience as a legal intern or clerk.
Desired Experience for Assistant Attorney 2: Four years of professional level legal experience as an attorney. Litigation experience is highly desired

APSIN Clearance
Please be aware – this position works directly with CBJ systems that may include assistance with a department’s Alaska Public Safety Information Network (APSIN). This requires the incumbent to submit to a pre-employment fingerprint based criminal history background check. Due to the sensitive nature of this position, and required access to APSIN, an applicant with adult criminal convictions will not move forward in the recruitment and selection process. The Department of Public Safety (DPS) will deny security clearance for any applicant who has been convicted of a felony or misdemeanor in this state or another jurisdiction, or who may be a fugitive from justice. Additionally, security clearance will be withdrawn if DPS discovers that material information was falsified or omitted at the time of the initial application for security clearance. Final offer of employment is contingent on obtaining DPS security clearance. Background check authority: A.S. 12.62 and 13 AAC 68.215.
