About the NDIS Quality and Safeguards Commission

The NDIS Quality and Safeguards Commission (the Commission) is a regulator established on 1
July 2018 as an independent agency under section 181A of the National Disability Insurance
Scheme Act 2013 (the NDIS Act) to improve the quality and safety of NDIS supports and services.
The Commission is the dedicated national regulator of NDIS service providers in Australia.

During its formative phase, the Commission’s focus was on establishing the essential systems
and processes needed to meet its legislated responsibilities. The Commission is transitioning
from “start-up” to the scale-up maturing of its operations to becoming an effective,
approachable and transparent regulator.

The NDIS Commission’s core legislative functions
The Commission assists the Commissioner in the performance of their functions, the core of
which are to:

  • Uphold the rights of, and promote the health, safety and wellbeing of, people with disability
receiving supports or services, including those received under the National Disability
Insurance Scheme.
  • Develop a nationally consistent approach to managing quality and safeguards for people
with disability receiving supports or services, including those received under the National
Disability Insurance Scheme.
  • Promote the provision of advice, information, education and training to NDIS providers and
people with disability.
  • Secure compliance with relevant legislation through effective compliance and enforcement
arrangements, including through the monitoring and investigation functions conferred on
the Commissioner by legislation.
  • Promote continuous improvement amongst NDIS providers and their delivery of
progressively higher standards of supports and services to people with disability.
  • Develop and oversee policy design for a nationally consistent framework relating to the
screening of workers involved in the provision of supports and services to people with
disability.
  • Provide advice or recommendations to the National Disability Insurance Agency (NDIA) and
its Board in relation to the performance of the Agency’s functions.
  • Engage in, promote and coordinate the sharing of information to achieve the objects of the
relevant legislation.
  • Provide NDIS market oversight, including:
i. monitoring changes in the NDIS market which may indicate emerging risk; and
ii. monitoring and mitigating the risks of unplanned service withdrawal.


Legal Services and Internal Integrity Division
Our day-to-day work has a direct and immediate impact on the lives of people with disabilities,

The Legal Services and Internal Integrity Division is comprised of the Legal Services Branch and
the Internal Integrity Unit.

The Division is headed by the NDIS Commission’s General Counsel. Division staff members are
based in Parramatta, Penrith, Melbourne, Adelaide, Brisbane, Canberra, and Perth.

The Internal Integrity Unit
The Internal Integrity Unit is comprised of two teams – (i) Integrity Investigations and (ii)
Administrative Review & Governance. The Administrative Review & Governance team is responsible
for the following functions:

  • Coordinating the process for compliance by the NDIS Commission with its legislative
obligations.
  • Processing requests for NDIS Commission documents under the Freedom of Information
Act 1982 (Cth).
  • Co-ordinating internal reviews of decisions made by the NDIS Commission under the
National Disability Insurance Scheme Act 2013 (Cth) (NDIS Act).
  • Managing the NDIS Commission’s privacy function, including handling privacy inquiries,
privacy complaints and requests for access to and correction of personal information
under the Privacy Act 1988 (Cth); and
  • Building capability across the organisation, including providing education to Commission

Key duties
The Administrative Review Officer is responsible for assisting the Internal Integrity Unit in
effectively implementing the NDIS Commission’s legislative obligations and functions in one or
more of the following areas:

Privacy
  • Assist with assessing the NDIS Commission data handling practices, privacy
policies, procedures and guidelines to identify gaps and non-compliance with
privacy reforms.
  • Action the privacy reforms roadmap to ensure alignment with scope, deliverables
and timelines.
  • Implement privacy policies and procedures and guidelines that align with best
practice.
  • Effectively communicate with stakeholders to keep informed of progress of the
privacy reform project and assist with the integration of privacy reforms across all
areas of the NDIS Commission.
  • Contribute to privacy training and awareness programs to educate employees
about privacy requirements, data protection and their roles and responsibilities in
safeguarding personal and sensitive information held by the NDIS Commission.
  • Assist with change strategies to ensure a smooth transition to new policies and
procedures, address resistance to change and provide support to employees as
they adapt to new requirements.
  • Evaluate and monitor compliance with privacy reforms and best practices to
identify improvement measures.

Internal Review
  • Draft administrative decisions, brief delegates and co-ordinate responses relating
to complex or sensitive matters relating to the functions of the Internal Integrity
Unit. This will include effectively managing multiple matters, which may include
freedom of information requests, complaint or public interest disclosure
investigations, internal reviews or privacy matters;
  • Co-ordinate and gather information relating to matters and monitor compliance
with statutory and internal timeframes;
  • Use appropriate tools (including the Microsoft Office suite) and templates to aid
processing of and reporting on matters against tight deadlines;
  • Respond to inquiries regarding the functions of the Internal Integrity Unit to
internal and external stakeholders;
  • Work collaboratively with staff of the NDIS Commission, including with Legal
Services Branch in relation to external review proceedings and with decision-
makers in relation to freedom of information and internal review matters;
  • Manage highly sensitive or confidential material, including public interest
disclosures, treating information with appropriate sensitivity; and
  • Assess and develop practice with a continuous improvement lens to develop
capability within the NDIS Commission. FOI
  • Assist the freedom of information (FOI) team in creating, processing, and making
FOI decisions, including routine and sensitive access requests, ensuring all matters
are recorded and closed correctly.
  • Frequently liaise with business areas to identify relevant documents and consult
on proposed exemptions.
  • Effectively engage with FOI applicants, other Commonwealth and State agencies
and third parties in formal consultation processes.
  • Draft FOI decisions with limited supervision, and brief delegates in relation to
requests for access to documents made under the FOI Act.
  • Demonstrate good judgement and pay careful attention to detail in order to make
lawful decisions confidently, while undertaking analysis and drawing accurate
conclusions based on evidence.
  • Assist the Senior FOI Officer and Assistant Director in responding to requests for
information from the Office of the Australian Information Commissioner (OAIC)
relating to applications for OAIC review of FOI decisions.
  • Assist in developing and maintaining internal FOI reference materials including FOI
templates and other reporting functions, as needed.
  • Manage confidential material and treat information with appropriate sensitivity.
The Administrative Review Officer is also responsible for assisting the Assistant Directors and
the Director with any other tasks as is required from time to time.

Skills, Knowledge, and Personal Attributes
The role would suit critical and creative thinkers with excellent attention to detail, and a passion
for effective client service, process improvement and delivering positive outcomes in an
integrity context. To be successful in the role, you must have excellent organisational skills, work
well in a fast-paced environment and enjoy juggling multiple competing priorities.


Minimum Mandatory Requirements
To be considered for this role, candidates must have at least 12 months experience in one or more
of the following:

  • working with the Privacy Act 1988 and best practices in privacy and risk management;
and/or
  • handling internal review requests, administrative decision-making, or similar at a
Federal or State level; and/or
  • handling FOI requests or similar at a Federal or State level, including practical
experience in effectively applying FOI legislation.

In addition, candidates must demonstrate:

  • Excellent interpersonal skills to positively engage and collaborate with stakeholders at all
levels;
  • Ability to quickly learn and acquire skills and knowledge in an unfamiliar area of work or
subject matter; and
  • Work experience or familiarity with government operations and procedures.

Highly Desirable
The following qualifications, knowledge and experience are highly desirable (but not mandatory):

  • Qualifications in law or public administration.
  • Knowledge of the NDIS and an understanding of the role of the NDIS Commission.
  • Experience working in the disability sector.

Eligibility Requirements
  • NDIS employees are required to be Australian Citizens.
  • Candidates employed by the NDIS Commission are required to undertake a Police
Records Check prior to commencement of employment. If the position involves working
with children and/or vulnerable people, the appropriate check for this will also be
required to be undertaken.
  • Successful candidate(s) will be required to obtain and maintain at least a baseline
security clearance.

To be eligible to obtain a security clearance (Baseline, Negative Vet 1 or Negative Vet 2) the

successful candidate must be an Australian Citizen. Candidates must be able to establish their
background as checkable to be considered eligible for a security clearance. Any gaps or
periods of time spent overseas for 12 or more months (cumulative) that cannot be verified by
an Australian referee are typically deemed uncheckable, rendering the candidate ineligible for
a security clearance. Background history must cover 5/10 years (Baseline / Negative Vet 1 or

Negative Vet 2) of employment, education, residential, criminal history and anything else
specified by the AGSVA. The successful candidate must be willing to disclose all relevant and
required information to fulfil this process.

The assessment/selection process
The merit assessment process is chosen to suit the circumstances of the vacancy, the business

environment in which it operates and generally includes the following stages:

Further assessment
The selection panel (usually 2-3 people) acquires as much information as they

consider necessary. This may include contacting referees, undertaking an interview,
a work sample test and/or psychometric testing may also be included in the
