Metro Vancouver Transit Police ("Transit Police") is the leader in regional public transit policing, operating across 22 communities. It provides policing services to all modes of transit: Bus, Sea Bus, Sky Train, and West Coast Express. In partnership with cross-regional partners, Transit Police prevents crime and provides coordinated police services to transit users throughout the region. Responsibilities

PRIMARY PURPOSE
Manages the Information Access (FOI) program for TSML and the MVTP Police Board and act as the organization’s key delegate for all FOI related matters; manages incoming requests for information under the Freedom of Information & Protection of Privacy Act (FIPPA) and handles complex requests for TSML and MVTP Police Board as required. Formulates solutions for complex and sensitive requests across all levels within organizational constraints, Provincial and/or Federal Act restrictions, internal controls, adhering to strict legislated timelines. Ensures that TSML and Police Board are compliant with the requirements under the Freedom of Information & Protection of Privacy Act (FIPPA); monitors and manages changes to legislation and regulations.

KEY ACCOUNTABILITIES
  • Manages FOI process by receiving and responding to requests for records submitted by external and internal stakeholders to TSML and MVTP Police Board within the legislated timelines under FIPPA; identifies priority requests and manages completion of work to ensure achievement of timelines.

  • Responds to complex requests involving review of multiple legislation. Ensures TSML and MVTP Police Board compliance with FIPPA; monitoring and managing changes to legislation. Liaises with respective departments if required for FOI requests and provides process overview, recommending responses based on the nature and scope of requested records. Calculates and provides fee estimates where applicable.

  • Reviews complex FOI requests involving highly sensitive requests involving police files, ensures appropriate release of information and mitigates risk to the organization as it relates to the release of sensitive information. Determines appropriate disclosure of information and uses video software editing to redact information not required to mitigate risk. Reviews graphic and sensitive information, assault, suicide and determining the disclosure of information – video release requests, uses video software to redact information not required to be released.

  • Manages highly sensitive and complex law enforcement records and uses methods to prevent delays such as phased release or further amendment to request scope, when necessary, within TSML constraints, other law enforcement enactments and internal controls that adhere to strict legislated timelines. Advises and/or coordinates the transfer of requests to other respective agencies.

  • Designs, develops and implements consistent, effective privacy practices, processes and procedures to ensure efficiency, effectiveness and minimal risk and protection of the privacy and confidentiality of TSML information. Develops and maintains procedure manuals as it relates to the methods and processes for the review of files and FOI requests.

  • Acts as a subject matter expert on information access and provides advice, guidance and awareness to employees and senior leadership across TSML on FOI related topics, FIPPA requirements and related processes. Maintains FOI system, database and tracking list; troubleshoots and resolves technical issues, as required. Scans responsive records into redaction system; utilizes several related software for severing of CCTV footage.

  • Ensures TSML and MVTP Police Board compliance with FIPPA; monitors and manages changes to legislation. Develops reports and presentations to present recommendations to senior leadership and the Board on legislative and regulatory compliance.

  • Controls and authorizes the release of information related to information access by collecting and collating material related to response, reviewing documents, interpreting and applying provisions of FIPPA while adhering to other Provincial and/or Federal Acts. Makes decisions on the severing of information as permitted, responding directly to requesters. Releases appropriate information in accordance with strict legislated timelines.

  • Conducts complex analysis to review previous cases; prepares and presents reports. Conducts and reviews privacy impact assessments and provides advice and guidance to new and existing projects related to personal information and privacy risks. Participates in the development or revision of policies related to FOI or collection of evidence; participates in committees or provides external reviews.

  • Develops and delivers presentations and reports; attends board meetings to deliver recommendations related to FOI processes, legislative changes and the redaction of information.

  • Builds and maintains relationships with FOI applicants such as media/special interest groups, political parties, businesses, unions, students, lawyers, different government agencies and ministries, claimants and past employees, third parties, other public bodies and internal staff at TSML and, where required, across the Trans Link enterprise.

  • Collaborates closely with Communications department to prepare and respond to issues resulting from the release for “general” (non-personal) information, including those which are politically sensitive or may attract media attention. Provides copies of intended releases to allow for preparation of corporate messaging and further discussions, with key staff, prior to disclosure. Produces statistical information regarding FOI request volumes, classification/type and timelines, in response to requests by the Board of Directors, Police Board, Chief Officer Command Accountability Review and Legal Counsel.

  • Liaises directly with the Office of the Information and Privacy Commissioner to investigate complaints arising from withheld information or invasion of privacy arising from and information access release. Prepares documents response to defend corporate decision in the regard. Represents TSML and MVTP Police Board in appeals before the Commissioner in conjunction with TSML and/or MVTP Police Board Legal Counsel.

  • Alerts the Senior Legal Counsel on sensitive or controversial issues related to information access requests, including significant or precedent-setting decisions made by the Privacy Commissioner that could affect TSML’s and the MVTP Police Board interpretation and application of the Act.

  • Collaborates with the Information Management Services manager to ensure that TSML Corporate Records Management System (Open Text OWL) and practices, including classification, retention and destruction of records, and staff training and account management adhere to and are consistent with policies and procedures relating to the Freedom of Information and Privacy Act.

  • Provides leadership to reporting support staff, including recruitment, selection, coaching, development, managing performance and all other aspects of people management.
Work Schedule

37.5 hours per week.

Rate of Pay

Salary Range $82,400 to $123,600.
