About the NDIS Quality and Safeguards Commission


The NDIS Quality and Safeguards Commission (the NDIS Commission) is an independent
agency established on 1 July 2018 to improve the quality and safety of NDIS supports and
services. The NDIS Commission is the dedicated national regulator of NDIS service providers
in Australia and a non-corporate entity under the Public Governance, Performance and
Accountability Act 2013.

The NDIS Commission’s core legislative functions are to:


  • uphold the rights of, and promote the health, safety and wellbeing of, people with
disability receiving supports or services, including those received under the National
Disability Insurance Scheme
  • develop a nationally consistent approach to managing quality and safeguards for people
with disability receiving supports or services, including those received under the
National Disability Insurance Scheme
  • promote the provision of advice, information, education and training to NDIS providers
and people with disability
  • secure compliance with relevant legislation through effective compliance and
enforcement arrangements, including through the monitoring and investigation
functions conferred on the NDIS Commissioner by legislation
  • promote continuous improvement amongst NDIS providers and the delivery of
progressively higher standards of supports and services to people with disability
  • develop and oversee the broad policy design for a nationally consistent framework
relating to the screening of workers involved in the provision of supports and services to
people with disability
  • engage in, promote and coordinate the sharing of information to achieve the objects of
the relevant legislation, and
  • provide NDIS market oversight, including:
I. by monitoring changes in the NDIS market which may indicate emerging risk; and
II. by monitoring and mitigating the risks of unplanned service withdrawal.

About this opportunity
Regulatory Operations Division
The Regulatory Operations Division oversees regulatory and compliance operations,
including incident response, compliance monitoring and investigations. It is responsible for
the approval of providers, suitability assessments and manages the national Worker
Screening database. It uses a range of compliance and enforcement tools to support quality
services and safeguarding of participants. It manages key stakeholder interactions with
other regulators, enforcement and government agencies. It contributes to the development
of regulatory practice and policy, strategic initiatives, and regulatory campaigns. The
Division has three key branches and a small office supporting the Deputy Commissioner:

  • Market Operations,
  • Regulatory Campaigns and Projects,
  • Compliance and Enforcement, and
  • Office of the Deputy Commissioner.
Operational Assessment
Operational Assessment supports the Commission’s Regulatory Approach by undertaking
reviews of identified matters across all of its operational areas. The team makes
recommendations at the individual case and enterprise-wide level to achieve the
Commission’s objectives and includes:

1. A risk-based approach to review serious matters across reportable incidents,
compliance, investigations and complaints,

2. Identifying matters through systems and data interrogation for sample testing across
incident types, regulatory functions, jurisdictions and dates,

3. Making recommendations on whether or not actions were appropriate and
proportionate, the reasonableness of communication activity with participants and
other stakeholders,

4. Managing referrals from participants, family and/or support members or workers
relating to historic matters.

5. Drawing on insights, identifying thematic issues and patterns that create opportunities
to improve regulatory operations and inform future regulatory activity across the
Commission.

6. Linking in with existing external and own-motion projects and reviews that to identify
relevant matters.

Key duties of the role
The successful candidate/s will report to the Executive Director – Operational Assessment,
and will:

1. Lead and coordinate compliance monitoring and investigative activities, designed to
identify operational and regulatory actions that do not appear appropriate and
proportionate in their compliance and enforcement response.

2. Liaise with internal stakeholders and external government agencies, share relevant
information and produce briefing papers.

3. Conduct quality assessments on identified cases, briefings, administrative decisions and
use of statutory powers and make recommendations about reopening historic matters
or escalating issues to inform operations where appropriate.

4. Prepare senior executive briefs and reports on activities.
5. Engage across the full range of Commission functions, identifying and fostering
opportunities to deploy cross-functional strategies to address consistency in approach.

6. Manage a small team, including providing direction, human resources, conflict
resolution, coaching, workload and performance management.

5. Excellent planning and organisational skills, including demonstrated ability to establish
an action plan for self and others to complete work efficiently and on time by setting
priorities, establishing timelines, and leveraging resources.

6. Excellent decision-making skills, including:
  • The ability to identify and understand problems and opportunities by gathering,
analysing, and interpreting quantitative and qualitative information;
  • Choosing the best course of action by establishing clear decision criteria,
generating and evaluating alternatives, and making timely decisions; and
  • Taking action that is consistent with available facts and constraints and
optimises probable consequences
7. An ability to identify opportunities for continuous improvement to achieve quality
outcomes.

8. Strong writing skills, including a proven ability to draft briefings and administrative
decisions.

9. The ability to use effective involvement and persuasion strategies to gain acceptance of
ideas and commitment to actions that support specific work outcomes.
10. The ability to take prompt action to accomplish work goals, take action to achieve
results beyond what is required and be proactive.


Essential and desirable requirements


To be considered for appointment to this role, applicants must be able to demonstrate
that they possess:
1. Demonstrated executive-level experience in a compliance or investigations role with a
regulatory, law enforcement, or other government agency is highly desirable;
2. A tertiary level qualification in Investigations, Regulatory Compliance, Compliance or
Risk Management (or equivalent) is desirable;
3. Experience in using information and evidence gathering powers of the kind available to
the NDIS Commission, and seeking outcomes (administrative, civil, criminal) of the kind
available to the NDIS Commission is desirable;
4. Knowledge of the NDIS and an understanding of the role of the NDIS Commission is
desirable; and,
5. Knowledge of the issues facing people with disability in the context of their rights,
health, safety and wellbeing is desirable.
Employment suitability requirements
All NDIS Commission personnel are required to meet employment suitability requirements
prior to, and throughout, their employment.

Pre-employment
To be considered in this role, candidates will need to:

  • be an Australian Citizen, and
  • have a favourable National Police Check, and
  • have or be willing to obtain and maintain a Baseline Vetting security clearance. Should
business need arise, be willing to obtain and maintain a Negative Vetting Level 1 or

  • complete an NDIS Commission external influences and associations declaration form.
Ongoing suitability
NDIS Commission employees are required to comply with the APS Code of Conduct,

The NDIS Commission completes regular internal screening, monitoring and assessments to
ensure all employees meet employment suitability requirements.

Shortlist Applicants for this process will be assessed on their written application
using the APS Work level standards and Integrated Leadership System
(ILS). Shortlisting is undertaken to identify the applicants with the
strongest claims.
Interview Shortlisted applicants will be invited to attend an interview. Interviews
may be held in person, by phone or video (Microsoft Teams)
Referees Attach an up-to-date Curriculum Vitae (CV) and the contact details for
two referees, one of whom must be your current (or most recent)
supervisor.

Complete
After the delegate has approved the assessment outcomes all
applicants will be notified.
Further assessment
The selection panel (usually 2-3 people) acquires as much information as they consider

necessary. This may include contacting referees, undertaking an interview, a work sample
test and/or psychometric testing may also be included in the assessment. The contact
